Justice Qazi Faiz Isa has requested that there should be immediate appointments of Supreme Court judges to vacant posts.
In the text of Justice Qazi Faiz Isa’s letter written to the Chairman Judicial Commission and other members on April 29, it was said that the posts of 2 judges are vacant in the Supreme Court from July 13 and August 13, 2022. It has been 19 months since Justice Mazhar Alam Mian Khel and Justice Sajjad Ali Shah retired.
Justice Qazi Faiz Isa said in the letter that the Constitution says that the Chief Justice and other judges are the Supreme Court. If the Supreme Court is kept incomplete for no reason, then in my opinion it is not in accordance with the law. Currently, the number of pending cases in the Supreme Court is about 53 thousand. Nine years ago, the number of pending cases was half of what it is today.
He said that due to the large number of pending cases, the interests of Cylin are being harmed. Appointments should be made before the summer vacation for the 2 vacant posts. All the members of the Judicial Commission will be present before the vacation.
Justice Qazi Faiz Isa said that considering the constitutional responsibility, I recommend the names of 2 judges. I recommend the names of Chief Justice Sindh High Court Ahmed Ali Sheikh and Chief Justice Peshawar High Court Musrat Hilali.
The letter said that people will be disappointed if the Chief Justice of the Sindh High Court is not brought to the Supreme Court. The people of Khyber Pakhtunkhwa complain that they have only one judge of the Supreme Court. The Constitution of Pakistan teaches equality and prohibits discrimination. Justice Qazi Faiz Isa further said that the constitution prohibits discrimination of place of birth, residence, sex and ethnicity. The Chief Justice is requested to call a meeting of the Judicial Commission soon.
